1. Emergency & Crisis Disclaimer

1.1 This Platform is not an emergency service. If you are in danger, considering harming yourself or others, or require urgent medical or mental health support, you must not rely on this Platform.

1.2 In an emergency, you should:

  • Dial 999 or 112

  • Visit your local A&E

  • Contact your GP immediately

 

2. Who We Are

2.1 This Platform is operated by The Online Therapy Clinic UK LTD, trading as:

  • The Online Therapy Clinic

  • Minds Over Business

2.2 In these Terms:

  • The Platform”, “This Platform”, “The Service” or “Our Service” refers to Online-cbt.com/The Online Therapy Clinic/Minds Over Business.

  • You”, “Your” refers to the user.

  • Associates” or “Our Therapists” refers to therapists, counsellors, assessors, psychologists, psychiatrists, or other mental‑health professionals who provide services through the Platform.

2.3 By accessing the Platform or booking a session, you agree to these Terms. If you do not agree, you must not use the Platform.

 

3. Our Role & Relationship With Therapists

3.1 The Platform provides access to mental‑health services, including connecting users with Associates for online or face‑to‑face consultations.

3.2 The Platform’s role is limited to enabling you to book therapy sessions. The therapy services themselves are the responsibility of the Associate providing them.

3.3 When you book or attend a session, you enter into a direct agreement with the Associate, not with the Platform.

3.4 The Platform is not a party to any agreement between you and an Associate and accepts no responsibility or liability for the Associate’s services.

3.5 Each Associate provides services under their own professional terms and conditions, which apply in addition to these Terms.

 

4. Eligibility & User Responsibilities

4.1 You must be at least 18 years old to use the Service for yourself.

4.2 If you use the Service on behalf of someone under 18 or someone lacking capacity, you confirm that you have the legal authority or explicit consent to do so.

4.3 You agree to ensure that the person attending therapy complies with these Terms and the Therapist/User Agreement.

4.4 You must provide accurate information, including:

  • Name

  • Email address

  • Contact details

  • GP details

  • Emergency contact

4.5 If you decline to provide required safety information, you accept full responsibility for any consequences. The Platform or Associate may decline or discontinue services if necessary.

 

5. Using the Platform

5.1 Equipment

You are responsible for ensuring you have a suitable device and internet connection for online sessions.

5.2 Booking Sessions

  • You may request sessions via email or through the booking system.

  • A booking becomes binding only when confirmed by the Associate.

5.3 Communications

  • Messages sent to the Platform may be forwarded to Associates.

  • Your first name may be shared with Associates.

  • Messages may be decrypted for administrative support only.

  • The Platform does not vet clinical content of messages.

  • The Platform accepts no liability for message content.

5.4 Participating in Sessions

  • Associates are responsible for the content of their sessions.

  • The Platform does not vet therapeutic methods, techniques, or approaches.

  • You may provide private feedback to the Platform; this is used internally only.

  • You must not record sessions.

5.5 Your Health

  • You are responsible for ensuring you are fit to undertake therapy.

  • The Platform is suitable only for mild to moderate mental‑health concerns.

  • Therapy is not a substitute for medical examination or emergency care.

  • Free content on the website is for general information only and not medical advice.

 

6. Therapists / Associates

6.1 All Associates confirm that they are accredited or registered with an appropriate professional body (e.g., BABCP, BACP, UKCP, HCPC, EMDR UK).

6.2 The Platform does not independently verify clinical competence beyond receiving confirmation of accreditation.

6.3 Associates confirm that they comply with GDPR, ICO requirements, and maintain appropriate insurance.

6.4 The Platform does not guarantee:

  • The accuracy of Associate profiles

  • Availability or responsiveness

  • Suitability for your needs

  • Effectiveness of therapy

  • Outcomes of treatment

6.5 You take full responsibility for choosing to contact or attend sessions with an Associate.

 

7. Payments, Cancellations & Refunds

7.1 Payment Relationship

  • When you book a session, you enter a contract with the Associate, not the Platform.

  • The Platform provides booking, payment, and reminder systems.

  • The Platform may receive a commission from Associates.

7.2 Payment Methods

  • Payments may be made via card or approved online processors.

  • First sessions are paid at booking; subsequent sessions must be paid 48 hours (2 working days) in advance.

7.3 Cancellation Policy

  • Cancel 48 hours (2 working days) before the session for a full refund.

  • Cancellations after this period are charged in full.

  • Refund requests must be made via the booking system or by contacting the Associate or [email protected].

7.4 Associate Cancellations

You may request a refund or reschedule if an Associate:

  • Cancels within 48 hours

  • Is more than 20 minutes late

  • Fails to attend a booked session

Refunds are granted at the Platform’s discretion.

7.5 Additional Payment Terms

  • Charges are typically in GBP (£).

  • The Platform is not responsible for bank or payment‑provider fees.

  • Internet security cannot be guaranteed; the Platform is not liable for losses arising from email or online payment transmission.

 

8. Suspension or Termination of Service

Associates may suspend or terminate services if:

  • You breach these Terms

  • You provide inaccurate or misleading information

  • You violate laws or send inappropriate content

  • You infringe intellectual property rights

  • You violate privacy of others

  • You misuse the Service

Associates may share relevant information with the Platform to monitor compliance.

 

9. Complaints & Reporting

If you have concerns about an Associate, do not attend further sessions. You may report concerns to: [email protected]

The Platform does not endorse or guarantee any Associate’s credentials. You are responsible for verifying professional registrations.

 

10. Disclaimer & Limitation of Liability

10.1 The Platform is provided “as is”. 10.2 We do not guarantee uninterrupted access. 10.3 We are not liable for:

  • Failure to disclose health conditions

  • Actions or omissions of Associates

  • Loss of profits, business, or revenue

  • Business interruption

  • Loss of goodwill or reputation

  • Indirect or consequential losses

10.4 Nothing excludes liability for:

  • Death or personal injury caused by negligence

  • Fraud or fraudulent misrepresentation

  • Any liability that cannot be excluded under English law

 

11. Other Conditions

11.1 Variation

We may amend these Terms at any time. Continued use constitutes acceptance.

11.2 Assignment

We may assign our rights under these Terms. You may not assign yours without written consent.

11.3 Severability

If any clause is invalid, the remainder remains in force.

11.4 No Waiver

Failure to enforce a right does not constitute a waiver.

11.5 Entire Agreement

These Terms constitute the entire agreement between you and the Platform.

11.6 Governing Law

These Terms are governed by the laws of England and Wales. You submit to the exclusive jurisdiction of the English courts.
